ImagiNapoli Terms and Conditions 

1.   General

The following Terms and Conditions are the terms you, as ‘guest’, agree to in order to participate in a workshop or retreat with ImagiNapoli.  These terms and conditions explain the limits of our liability. By submitting your registration/booking form with payment of deposit, you consent to these Terms and Conditions. Therefore, please read these Terms and Conditions carefully before finalizing your reservation. Please print out the current version when making your reservation.

2.   Payment, Refund, Deposits, Cancellation and Program Modifications

a.   Payments

ImagiNapoli receives payments via PalPal. 

The following forms of payment are accepted:

MasterCard, Visa, and American Express, PayPal

Credit card and PayPal payments will be converted to Euro

Any currency conversion fees or differences in exchange rates are the responsibility of the guest registering for the workshop or retreat.

b.    Alternate Payments

We also accept bank wire transfers in US dollars drawn on a US bank. The amount will be converted to euros, and the difference in currency exchange rate will be the responsibility of the guests.  Please contact ImagiNapoli for additional information if paying by wire transfer.

c.    Registration/Booking and Deposit

Registration/Booking is considered complete when:

1.    You submit completed and signed hard copy or online registration/booking form stating understanding and acceptance of these terms and conditions.

2.    Your deposit is received and deposited.

3.    You have received a confirmation letter/email of the deposit and registration/booking.

d.   Deposit Non-Refundable

Deposits, in the amount specified by the workshop or retreat for which you are registering, are NONREFUNDABLE, except as noted in 2.j, and 2.k, below.

e.    Price Changes

All prices are subject to change without notice due to the unpredictability of program costs. However, the early bird price for the selected workshop/retreat will be locked and guaranteed upon receipt of FINAL payment, due 120 days prior to start date. Inside of 120 days prior to the workshop/retreat, the early bird price no longer applies and is subject to increase. Furthermore, the price due in full upon booking unless otherwise stated in the workshop/retreat pricing.

f.     Balance Due

The balance due must be paid in full 120 days prior to the start date of the workshop or retreat.  ImagiNapoli will invoice guests and will attempt to contact guests 2 times between 160 and 121 days prior to the start date.  If the balance due is not received by 120 days prior to the event, the deposit AND the space for the workshop or retreat will be forfeited. See 2.g for instances in which guests register/book less than 120 days prior to start date.

g.   Instances When Full Payment is Due upon Registration/booking

If you register/book a workshop or retreat less than 120 days before its start date, the early bird price will no longer apply. The new price as stated in the pricing for the workshop/retreat must be paid in full upon registration/booking.

h.   Participant Notice of Cancellation in Writing Required

If you must cancel your workshop or retreat, you must notify us in writing.  If only the deposit has been paid, no refund will apply.  After payment of the balance due, the following refund policy applies:

Written cancellation notice received 121+ days of start date will receive full refund, less deposit

Written cancellation notice received 91-120 days of start date will receive 75% of total funds paid, less deposit

Written cancellation notice received 61-90 days of start date will receive 50% of total funds paid, less deposit

Written cancellation notice received 0-60 days of start date will receive no refund 

i.     Returned Payments

Returned payments: If a payment is returned unpaid for any reason, we will contact payor immediately for a second and final attempt.  Payment must be received within 48 hours in order to retain the space in the workshop or retreat.  If payment due is not received within 48 hours of notice given, the space will be forefeited. 

j.     Event Cancellation – Minimum Participants not met

If a workshop or retreat doesn’t meet the minimum number of students required, the event will be canceled and notice will be given to guests 120 days prior to its scheduled start date.  Guests will receive 100% refund, including deposit.

ImagiNapoli is not liable for any other costs incurred such as flights, local transportation, etc.  For this reason, all guests are required to purchase travel insurance.

k.   Event Cancellation – Other Circumstances

In the unlikely event that ImagiNapoli is forced to cancel a workshop or retreat prior to its commencement for reasons beyond its control, such as any act of terrorism, war, accident, political unrest, lawlessness, epidemic or threat of epidemic, weather or any act of God, 100% of funds paid by guests will be refunded, including deposit. 

ImagiNapoli is not liable for any other costs incurred such as flights, local transportation, etc.  For this reason, all guests are required to purchase travel insurance.

l.     Program Modifications as May Be Necessary-Circumstances Beyond our Control

ImagiNapoli will make every attempt to adhere to the final published program itinerary.  However, occasional changes may be necessary as determined by weather, Italian transportation strikes, unexpected venue closures or other reasons beyond the control of ImagiNapoli.  In the unlikely possibility a program change is necessary, alternative activities or excursions may be substituted.  Such changes will not result in a refund.

m.  Program Modifications as may be necessary-Instructor Availability

In the unlikely event that the workshop/retreat instructor is forced to cancel, ImagiNapoli will proceed with the event and attempt to locate an alternate instructor.  If no alternates are available, a partial refund will be offered (equal to the instruction portion of the program cost) and ImagiNapoli will proceed with the scheduled events, reserving the right to make program substitutions while still providing a hosted vacation. 

3.   Disclaimer & Limit of Liability

a.   General

In no event shall ImagiNapoli or its officers, directors, employees and affiliates be liable to the customer for any injury, loss, or damage directly or indirectly arising from, or any indirect, incidental, special or consequential damages, incurred by passenger in connection with: (i) the workshop or retreat purchased hereby, including without limitation, any associated transportation, activities, and accommodations, whether prior, during or after the workshop or retreat, (ii) any act, omission, neglect, accident, error or default of third parties, providing services in connection with the workshop or retreat, (iii) the alteration of the passenger’s itinerary when advisable or necessary for the safety and/or well being of the customer, (iv) any act of terrorism, war, accident, political unrest, lawlessness, epidemic or threat of epidemic, weather or any act of God.

b.   Participant Risks and Responsibility

During the course of the program, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, bus, van, aircraft, or other means of transportation; stolen, lost, or misplaced luggage or property;  theft or break-ins into vehicles, lodging rooms or elsewhere; and accident or illness in remote regions without means of rapid evacuation or medical facilities. By agreeing to participate in a workshop or retreat, you agree you will hold ImagiNapoli harmless regarding any provision of medical care or the adequacy of any care rendered. Emergency Medical Travel Insurance is required – see Section 4, b and Section 5.  You hereby agree to be responsible for your own safety and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death. 

c.    Transportation

ImagiNapoli is not responsible for transportation delays caused by canceled or delayed flights, missed transportation connections or lost or delayed baggage

d.   Subject to Italian Law; Terms and Conditions of Independent Suppliers

All services and accommodations are subject to the laws and regulations of Italy. ImagiNapoli functions only as an agent for the various independent suppliers that provide accommodations, transportation, sightseeing, activities, or any other services connected with the workshop or retreat. Such services are subject to the terms and conditions of those suppliers.

4.   Guest Requirements and Responsibilities

a.    All guests must be 18 years of age or older

b.   Guests are required to have travel insurance that covers at least emergency medical overseas including medical transport, medical care and emergency evacuation.  It is strongly recommended that policies also include trip cancellation, trip interruption, missed connections, lost or delayed baggage, and any other non-reimbursable costs.  Travel insurance and emergency medical care are further discussed in Section 5 below.

c.    No children or pets (except service animals) are allowed on the workshops or retreats

d.   Guests are responsible for researching and providing appropriate entrance documentation for Italy.  This includes, but is not limited to: Passport, proof of vaccinations, and any other entrance requirement.  ImagiNapoli does not provide advice on or provide reimbursement for costs related to entrance requirements.

e.    US Citizens are strongly encouraged to register with the STEP program when traveling abroad.  The program enrolls your travel plans with the US State Department and helps the US Embassy contact you in the event of an emergency.  Read about the benefits here: https://step.state.gov/

f.     Guests must purchase travel insurance and provide the policy and phone number to ImagiNapoli not later than 75 days prior to start date.  See Section 5, “Travel Insurance and Medical Attention” below.

g.   Guests must be in good physical health, and able to do the following activities:

                        i.         Walking, including cobblestone streets, uneven pavements, dirt or sand paths, stairs, inclines, declines, and walking with luggage in tow

                      ii.         Boarding and disembarking from public transportation unassisted, including taxis, shuttles, trains, metro, and boats while handling one’s own luggage

                    iii.         Standing during artistic activities, while listening to tour guides, awaiting transportation or in lines

                     iv.         Handling one’s own luggage

                      v.         Ability to withstand exposure to elements during activities that may include sun exposure, heat, cold, wind, and rain and ability to take necessary precautions to remain safe and comfortable including use of hats, umbrellas, sunscreen, insect repellants, remaining hydrated, etc.

                     vi.         Be physically, mentally and emotionally capable of participating in the program and bring/utilize appropriate clothing, shoes, medicines, medical equipment, entrance documentation, proof of travel and medical insurance.

                   vii.         Be responsible for their own health and safety. 

                 viii.         Any guest conduct that compromises the safety, comfort, or convenience of other participants may result in removal from the workshop/retreat.  In those circumstances we have the exclusive right and discretion to expel a guest from the retreat or workshop without refund or compensation for costs incurred.  Guests are expected to stay with the group during the programmed itinerary, and adhere to any instructions that are given to ensure the safety and well-being of the group.  Any loss resulting from disregarding safety instructions is not the responsibility of ImagiNapoli or its Agents. 

h.   Bring art supplies as described for the workshop or retreat

i.      Bring appropriate adapters for electronics

5.   Travel Insurance and Medical Attention

a.   General

Guests are required to have travel insurance that covers at least emergency medical overseas including medical transport, medical care and emergency evacuation.  It is strongly recommended that policies also include trip cancellation, trip interruption, missed connections, lost or delayed baggage, and any other non-reimbursable costs.

b.   Medical Emergencies and Resulting Expenses

Guests agree to notify ImagiNapoli (or its Agents as appropriate) immediately of any medical emergencies, illness, injury or health-related requirements that arise during the retreat or workshop.  ImagiNapoli will assist as much as possible in the arrangement of transport and medical attention.  Any resulting hospital or medical provider expenses are the responsibility of the guest. 

c.    Allergies

Guests agree to notify ImagiNapoli (or its Agents as appropriate) of any known allergies so that caution may be taken to avoid exposure to allergens. 

6.   Program Information

a.   What is Provided

Unless otherwise specified in your workshop/retreat description, the program includes the following:

1)   Hotel accommodations arranged by ImagiNapoli

2)   Breakfast, mid-day snack, and dinner.  Dinner includes glass of wine.

3)   Local transportation including to/from airport

4)   Artist’s instruction

5)   Admissions to attractions and excursions as described in your selected retreat

6)   Supplies as described in the program

b.    Not Provided

Unless otherwise specified in your workshop/retreat description, the program EXCLUDES the following:

1)   Flights

2)   Baggage fees

3)   Airport transfers

4)   Drinks other than those provided with meals

5)   Snacks and other food outside of breakfast, lunch/mid-day snack, and dinner

6)   Excursions other than those listed in the workshop/retreat program

7)   Porterage of luggage

8)   Travel Insurance

9)   Items of a personal nature

10)         Items not specifically mentioned as included in our workshops/retreats

11)         Art supplies, except any listed in the workshop/retreat program

12)         Electrical adapters

7.   Privacy and Publication

a.    Privacy:

All information provided in a booking will be kept in a confidential manner. The information is not disclosed or sold to other entities for any purpose beyond what is needed to secure your travel arrangements with our suppliers/Agents. Mailing information and past travel information will be retained by us. You may receive mailings or email from us periodically. You may explicitly ask to be removed from said mailings by email.

b.   Photo and Video:

Any photographs, digital images or video (Imagery) that you provide, or that are taken by us or our Agents, are deemed to be our property and available for use in promotions we make without compensation for their use.  Imagery appearing on the web site, in social media, or any other promotion are used solely as an indication of accommodations and attractions. Actual facilities may vary.
